Learner Success Driving School, Terms and Conditions, for practical driving lessons
I, Richard Colyer, trading as Learner Success Driving School, only provide Training on the terms specified under the DIA Standard Terms and Conditions underwritten by FORD & WARREN Solicitors. A copy of these terms & conditions will be given to You (the Client) at the start of the first lesson, course or package (or as soon as practically possible after the first lesson), and will continue to be binding throughout the entire Training period irrespective of how long the Training period is, or of any breaks or gaps during the Training period.
The terms & conditions are important and should be studied carefully. The DIA Standard Terms and Conditions incorporate Clause 1.1 through 13.2 inclusive.
Some Amendments and Additions have been made to the DIA Standard Terms and Conditions which are exclusive to Learner Success Driving School. These are specified below as follows, and by accepting Training in order to learn to drive with Learner Success Driving School, You (the Client) also accept the terms and conditions of these Amendments and Additions.
Amendments and Additions to the DIA Standard Terms and Conditions
Section 3 CLIENT OBLIGATIONS
Additions to The DIA Standard Terms and Conditions Section 3 :
If the Client is normally required to wear glasses or lenses for driving and he fails to bring them to any Training Session, and is subsequently unable to wear them, the lesson will be cancelled and the Training Session will be charged for at the normal agreed rate. No refund will be payable if the Training Session was paid in advance.
The Client must advise the instructor if he is taking any medication or prescription drugs that may affect their ability to drive safely, before the Training Session starts.
Amendment to The DIA Standard Terms and Conditions Clause 3.3 :
The Client must ensure that he is in a fit state to drive safely, and at no time during Training is he suffering acute tiredness, illness, or under the influence of alcohol, drugs or any other substance, or any combination of these, or otherwise suffering a condition that may affect his ability to drive.
Amendment to The DIA Standard Terms and Conditions Clause 3.4 :
If at any time the Instructor, in his absolute discretion, considers that the Client is not in a fit state to drive safely, then the Instructor may refuse to proceed with the Training Session or stop the Training Session. The Training Session will be charged at the full Price, and if the Training Session was paid in advance no refund will be payable.
Section 6 TRAINING CANCELLATION OR POSTPONEMENT
Amendment to The DIA Standard Terms and Conditions Clause 6.1 :
Subject to Clause 6.2, either party may cancel or postpone a Training Session upon providing adequate notice of at least 24 hours. Failure to give such notice may result in the Client being charged the full Price unless the Client re-books the cancelled Training Session so it can be conducted with 72 hours after that cancelled Training Session. If the School/Instructor cancels a Training Session without giving 24 hours' notice or otherwise than in accordance with this agreement and these Terms and Conditions, then provided it is not as a result of circumstances outside the control of the School or under Clause 6.4 or 6.5 the School may be liable to the Client for the Price unless the Instructor re-books the cancelled Training Session so it can be conducted with 72 hours after that cancelled Training Session.
Addition to The DIA Standard Terms and Conditions Section 6 :
If the Client is not at the agreed pickup point at the agreed time, and does not attend the Training Session within 20 minutes from the agreed start time, the Training Session will be deemed to be cancelled by the Client and the full Price of the lesson will be payable.
Amendment to The DIA Standard Terms and Conditions Clause 6.2 :
Clause 6.2 applies in full as worded in the DIA Standard Terms and Conditions with exception of the stated administration charge of £5. For the purposes of Clause 6.2, the administration charge applied to the Client will be increased from £5 to £8 by Learner Success Driving School, and in fairness, if the School is liable to the Client for compensation, this will also be increased from £5 to £8 by Learner Success Driving School.
Section 7 PRACTICAL DRIVING TEST
Additions to The DIA Standard Terms and Conditions Section 7 :
Agreed Price for Driving Test. The Learner Success Driving School's Test fee, as agreed, allows for up to 2.5 hours and includes a 1 hour Training Session immediately prior to practical driving test, plus 20 minutes return to the Client's drop-off.
If the Client has been entered for a driving test and does not keep up to date with their lessons prior to the test, or has a break in driving lessons of 10 days or more between the last Training Session and the date of the driving test, or if in the opinion of the instructor, the pupil is not safe to proceed with the test, the Instructor reserves the right to refuse the use of the School Vehicle for the driving test, in which case the Instructor will not be liable for any loss of test fees incurred by the Client.
Section 10 PRICE AND PAYMENT
Additions to The DIA Standard Terms and Conditions Section 10 :
Where a minimum number of Training Sessions (otherwise known and referred to as Block Bookings) have been agreed in consideration for a discounted Price per Training Session as inserted in the agreement, there will be a limited time period in which to complete all the number of Training Sessions.
For a Block Booking of no more than 4 Training Sessions, the time period in which to complete all 4 Training Sessions will be no longer than 3 weeks from the date of the first Training Session.
For a Block Booking of no more than 10 Training Sessions, the time period in which to complete all 10 Training Sessions will be no longer than 6 weeks from the date of the first Training Session.
After the respective time period for each Block Booking has elapsed, all Training Sessions which have not yet been conducted will be considered to have been conducted, and the Block Booking will be considered complete. No refunds will be given for outstanding Training Sessions. Unless a new Block Booking is purchased by the Client, all subsequent Training Sessions will be charged at full Price.

Section 14 SPECIAL OFFERS
14.1 Introduce a friend.
If the Client introduces a friend, and that friend subsequently commences to learn to drive with Learner Success driving school, the Client will receive a Training Session of no more than 1 hour free of charge as means of reward for the introduction, after the friend has completed 6 hours of training sessions with Learner Success. Only 1 hour of free Training Sessions will be given per friend introduced to Learner Success driving school, but there is no limit to the number of friends that can be introduced in return for reward.
14.2 Up to £100 Cash Back offer
14.2.1 In order to qualify for Cash Back special offer reward, the test candidate must be an established Client with Learner Success driving school. To become an established Client, the Client must have had a minimum of 6 paid driving sessions with Learner Success driving school without break prior to the practical test, without prejudice to Section 7 regarding the Practical Driving Test. If the Client subsequently passes their practical test on their first attempt, and receives no minor faults during that test, the Client shall receive a financial reward of £100 from Learner Success, as long as the driving school test fee, currently £65, has already been paid by the client to Learner Success. Payment of the Cash Back reward to the Client will be by bank transfer only and will be paid within a reasonable time of the date of the practical test pass.
14.2.2 If the Client passes the practical test on their first attempt, but gets one minor fault on that test, the Client shall only receive a financial reward of £20, subject to the conditions in clause 14.2.1.
14.2.3 If the Client passes the practical test on their first attempt or any subsequent attempt and gets more than one minor fault, no financial reward shall be given.
